10. Fees and Payments

Use of many Services may require payment. You agree to pay all applicable fees and taxes for paid subscriptions or transactions. All payments are made in advance or as set forth in your order form. BLUTEC.ai may suspend Services for non-payment. Unless otherwise stated, refunds are at BLUTEC.ai's discretion and any free trials or promotional offers are limited to one per customer and subject to suspension or termination at our discretion.

11. Acceptable Use

You agree not to misuse the Services. In particular, you must comply with India's IT Act, 2000 and other laws.

12. Intellectual Property

BLUTEC.ai and its licensors retain all ownership of the software, trademarks, content, and materials provided in or through the Services. These Terms grant you a limited, revocable license to use the Services for your business purposes; no ownership of BLUTEC.ai's intellectual property is transferred to you. You may not copy, modify, distribute, sell, or reverse-engineer our technology.

13. User Content

You remain owner of any content (data, messages, media, etc.) that you upload or send using BLUTEC.ai's Services. By using the Services, you grant BLUTEC.ai a non-exclusive license to process and transmit that content as needed to provide the Services. We do not claim ownership of your content, but we reserve the right to remove any content that violates these Terms.

14. Service Level

BLUTEC.ai strives for ~90% uptime for its cloud-based services, but does not guarantee uninterrupted availability. Services may be temporarily unavailable due to maintenance, upgrades, outages, or force majeure events. We are not liable for any loss or damage from service interruptions. Users remain responsible for securely backing up their data.

15. Termination

Either party may terminate these Terms at any time. BLUTEC.ai may suspend or terminate your account and access to the Services with or without notice if you breach these Terms, engage in abusive or fraudulent activities, or if provision of the Services becomes illegal or impractical. On termination, your license to use the Services ends, and BLUTEC.ai may delete your content.

16–18. Disclaimers, Liability & Indemnification

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." BLUTEC.ai MAKES NO WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUTEC.ai's TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU TO BLUTEC.ai IN THE SIX MONTHS PRECEDING THE CLAIM. You agree to indemnify and hold harmless BLUTEC.ai from any claim arising out of your use of the Services.

19. Governing Law

These Terms are governed by the laws of India. Any dispute relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts of India. If any provision is found unenforceable, the remaining provisions will remain in effect.
